ACCEPTABLE USE POLICY

This Acceptable Use Policy (Policy) sets out the rules and guidelines for your use of the artificial intelligence features and services (AI Service) provided through the Lumen platform, including the website at thelumenapp.com.au and the Lumen mobile application (together, the Platform), operated by Lumen App Pty Ltd (ACN 696 182 386 / ABN 21 696 182 386) (we, us or our).
The AI Service supports personal reflection, goal-setting, and creative visualisation through AI-assisted manifestation tools, vision board generation, affirmation and prompt generation, and AI-assisted influencer personas modelled on or licensed from social media influencers, creators, and talent affiliated with Lumen.
This Policy forms part of, and must be read together with, our Website Terms of Use, Mobile App Terms of Use, Privacy Policy, and Website Disclaimer. By accessing or using the AI Service, you agree to comply with this Policy. If you do not agree, you must not use the AI Service.
OPERATIVE PROVISIONS
1. DEFINITIONS AND INTERPRETATION
Definitions
In this Policy, the following definitions apply:
AI Features | means the AI Service made available through the Platform, including AI-assisted manifestation tools, vision board generation, affirmation and prompt generation, influencer personas, and related features. |
AI Output | means any text, images, suggestions, affirmations, vision board elements, or other content generated by the AI Service in response to User Input. |
AI Service | means the artificial intelligence features and services made available through the Platform, including AI-assisted manifestation tools, vision board generation, affirmation and prompt generation, and AI-assisted influencer personas. |
Force Majeure Event | has the meaning given in clause 11.3. |
Harmful Content | means any content that is unlawful, defamatory, obscene, threatening, harassing, discriminatory, or otherwise objectionable, or that promotes or incites violence, self-harm, hatred, or illegal activity. |
Influencer Content | means any content featuring, created by, or co-created with social media influencers, creators, or talent affiliated with Lumen (including AI-assisted personas, voice, likeness, or style modelled on those influencers). |
Loss | means any loss, liability, cost, claim, expense, damage, charge, penalty, outgoing, or payment however arising, whether present, unascertained, immediate, future, or contingent, including reasonable legal costs on a solicitor and own client basis. |
Platform | means the Lumen website located at thelumenapp.com.au and the Lumen mobile application, including all pages, features, and content accessible through those channels. |
Policy | means this Acceptable Use Policy, as amended from time to time. |
Professional Advice | means advice of a medical, psychological, psychiatric, therapeutic, legal, financial, tax, accounting, or other professional nature that requires a qualified and licensed practitioner to provide. |
Sensitive Input | means any User Input that contains or relates to personal health information, mental health concerns, medical symptoms or conditions, suicidal ideation, self-harm, substance abuse, or any other information of a sensitive or vulnerable nature. |
User Input | means any text, data, prompts, questions, instructions, images, or other content submitted by you to the AI Service (including when creating or editing a vision board). |
Interpretation
In this Policy, unless the context otherwise requires:
- headings are for convenience only and do not affect interpretation;
- the singular includes the plural and vice versa;
- a reference to a statute, regulation, or other law includes all amendments, consolidations, and replacements;
- a reference to writing includes email; and
- terms defined in the Website Terms of Use or Mobile App Terms of Use have the same meaning in this Policy unless otherwise defined.
2. SCOPE OF THIS POLICY
- This Policy applies to all users of the AI Service, whether accessed through the website, the Lumen mobile application, or any other channel through which the AI Service is made available.
- This Policy supplements the Website Terms of Use and the Mobile App Terms of Use. To the extent of any inconsistency between this Policy and those terms in relation to the use of the AI Service, this Policy prevails.
- We may update this Policy from time to time. Any changes will be effective immediately upon posting the updated Policy on the Platform. Your continued use of the AI Service after any changes constitutes your acceptance of the revised Policy.
3. NATURE OF THE AI SERVICE
- The AI Service is provided for personal development, goal-setting, creative visualisation, reflection, and entertainment purposes only. The AI Service is not designed, intended, or authorised to provide Professional Advice of any kind.
- You acknowledge and agree that:
- the AI Service uses artificial intelligence technology (including machine learning models, large language models, and generative image models) that generates responses based on algorithms and training data, and does not involve any human review, oversight, or professional judgment unless expressly stated;
- AI Output may be inaccurate, incomplete, outdated, biased, misleading, hallucinated, or otherwise unreliable, and should not be relied upon as a basis for making decisions of any kind;
- the AI Service does not create any professional-client, advisory, therapeutic, medical, psychological, fiduciary, or similar relationship between you and us, or between you and any influencer, creator, or talent featured on the Platform;
- any AI Output that touches on topics related to health, wellbeing, mental health, relationships, finances, legal matters, or any other area in which Professional Advice may be relevant is provided for general informational and personal development purposes only and must not be treated as Professional Advice;
- the AI Service does not promise, guarantee, or represent that the use of Lumen, the AI Features, or any manifestation or vision board practice will produce any particular life, financial, health, relationship, career, or other outcome; and
- you are solely responsible for evaluating and verifying any AI Output before acting on it, and for seeking appropriate Professional Advice where required.
4. PERMITTED USE
- You may use the AI Service only for its intended purpose of personal development, goal-setting, creative visualisation, reflection, and entertainment, and in compliance with this Policy, the Website Terms of Use, the Mobile App Terms of Use, and all applicable laws.
- You must be at least 18 years of age to use the AI Service. If you are under 18, you must not access, create an account with, or use the AI Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account in connection with the AI Service.
5. PROHIBITED CONDUCT
- When using the AI Service, you must not:
- use the AI Service for any unlawful, fraudulent, or harmful purpose;
- submit any User Input that constitutes or contains Harmful Content;
- attempt to use the AI Service to generate Professional Advice or to obtain outputs intended to substitute for consultation with a qualified professional (including advice relating to medical, psychological, psychiatric, legal, financial, tax, or accounting matters);
- submit User Input that is designed to manipulate, deceive, or exploit the AI Service, including through prompt injection, jailbreaking, or other techniques intended to circumvent the AI Service's safety measures, content guidelines, or persona constraints;
- use the AI Service, or any AI Output, to generate content that infringes, misappropriates, or violates the intellectual property rights, privacy rights, image rights, or other rights of any third party (including any influencer, creator, or talent featured on the Platform);
- use the AI Service to impersonate any person or entity (including any influencer, creator, or talent featured on the Platform), or to misrepresent your affiliation with any person or entity;
- use the AI Service, or any AI Output (including any output modelled on an influencer's voice, likeness, or persona), to create deepfakes, sexualised content, harassing content, political endorsements, or content that falsely attributes statements, views, or endorsements to any person;
- use the AI Service to generate spam, phishing content, malware, or any content intended to deceive or defraud others;
- use the AI Service to harass, bully, stalk, intimidate, or threaten any person;
- use the AI Service to generate content that sexualises minors or that facilitates the exploitation or abuse of children in any way;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, training data, or underlying models of the AI Service;
- use any automated tools, bots, or scripts to access or interact with the AI Service, except through the interfaces we provide;
- use the AI Service, User Input, or AI Output to train, fine-tune, or develop any competing artificial intelligence product, service, or model; or
- use the AI Service in any way that could damage, disable, overburden, or impair the Platform or interfere with any other user's use of the AI Service.
6. SENSITIVE AND HEALTH-RELATED INPUTS
- The AI Service is not a medical, psychological, psychiatric, or therapeutic service. The AI Service is not designed to detect, diagnose, treat, manage, or monitor any medical or mental health condition, and it is not a substitute for professional medical, psychological, or psychiatric care.
- You acknowledge and agree that:
- you should not submit Sensitive Input to the AI Service;
- if you choose to submit Sensitive Input despite this warning, you do so entirely at your own risk;
- the AI Service is not equipped to provide an appropriate, safe, or reliable response to Sensitive Input, and any AI Output generated in response to Sensitive Input must not be treated as advice, guidance, or a recommendation of any kind;
- we do not monitor User Input for Sensitive Input in real time and we accept no responsibility for AI Output generated in response to Sensitive Input;
- the AI Service, including any AI-assisted influencer persona, is not authorised to provide crisis support, mental health intervention, or safety advice, and any response from an influencer persona on such topics is algorithmically generated and does not represent the views of the relevant influencer; and
- we are not liable for any Loss arising from or in connection with your submission of Sensitive Input or your reliance on any AI Output generated in response to Sensitive Input.

7. AI-GENERATED CONTENT
- You acknowledge that all AI Output is generated by artificial intelligence technology and not by a human. AI Output does not represent the views, opinions, or recommendations of us, our directors, employees, or agents, or of any influencer, creator, or talent featured on the Platform (even where the AI Output is generated in the style of, or by a persona modelled on, a particular influencer).
- We make no representations or warranties as to the accuracy, completeness, reliability, suitability, or timeliness of any AI Output. AI Output may contain errors, inaccuracies, biases, or hallucinated content (content that appears plausible but is factually incorrect).
- You must not:
- rely on AI Output as a basis for making any decision relating to your health, finances, legal affairs, safety, or any other matter of significance;
- publish, distribute, or share AI Output in a manner that presents it as human-authored content, professional advice, or factual information, or in a manner that falsely attributes views, statements, or endorsements to any person (including any influencer, creator, or talent featured on the Platform); or
- use AI Output for any commercial purpose, unless expressly permitted by your subscription terms.
- For the avoidance of doubt, nothing in this clause 7 restricts us from using, publishing, distributing, or sharing AI Output (including on social media platforms and through marketing campaigns) for any purpose connected with the operation, promotion, or marketing of the Platform and the AI Service.
- To the maximum extent permitted by law, we disclaim all liability for any Loss arising from or in connection with your use of, or reliance on, any AI Output, including any Loss arising from AI Output that is inaccurate, incomplete, misleading, offensive, or otherwise inappropriate.
8. USER CONTENT AND INPUTS
- You retain ownership of any intellectual property rights that you hold in your User Input. By submitting User Input to the AI Service, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, and process your User Input for the purposes of:
- operating, maintaining, securing, and improving the AI Service (including quality assurance and safety testing);
- generating AI Output in response to your User Input; and
- content moderation, safety, fraud prevention, and compliance with our legal obligations.
- Our handling of your personal information in connection with the AI Service is further described in our Privacy Policy.
- You represent and warrant that:
- you have all necessary rights, licences, and permissions to submit your User Input to the AI Service;
- your User Input does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, or other rights of any third party; and
- your User Input complies with this Policy and all applicable laws.
- We do not claim ownership of your User Input. However, you acknowledge that AI Output generated in response to your User Input may be similar or identical to output generated for other users, and you do not acquire any exclusive rights in AI Output.
9. MONITORING, MODERATION AND ENFORCEMENT
- We reserve the right (but are not obligated) to monitor, review, classify, and analyse User Input and AI Output for the purpose of ensuring compliance with this Policy, detecting and responding to Harmful Content or Sensitive Input, improving the AI Service, and protecting the safety of our users and of any influencer, creator, or talent featured on the Platform. This may involve automated content filtering, human review, and the retention of moderation records.
- If we determine, in our sole discretion, that you have breached this Policy, we may take any one or more of the following actions without prior notice:
- issue a warning to you;
- temporarily or permanently suspend or restrict your access to the AI Service, the Platform, or your subscription;
- remove or disable access to any User Input or AI Output that breaches this Policy;
- report the breach to relevant law enforcement authorities or regulatory bodies; and
- take any other action we consider reasonably necessary to protect our rights, the rights of our users or affiliated talent, or the integrity of the AI Service.
- Our decision to take or not take enforcement action in any particular instance does not constitute a waiver of our right to take enforcement action in relation to any other breach of this Policy.
10. DISCLAIMERS AND LIMITATION OF LIABILITY
- The AI Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all representations, warranties, and conditions of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
- Without limiting clause 10.1, we do not warrant or represent that:
- the AI Service will be available without interruption, or that any defects will be corrected;
- the AI Service will be free of viruses, errors, or other harmful components;
- AI Output will be accurate, complete, reliable, current, appropriate, or fit for any particular purpose;
- any influencer persona available through the AI Service will respond in a manner consistent with the views, style, or recommendations of the relevant influencer; or
- the AI Service or the use of Lumen will produce any particular outcome, result, or benefit in your life.
- To the maximum extent permitted by law, we exclude all liability (whether in contract, tort (including negligence), statute, or otherwise) for any Loss arising out of or in connection with your use of the AI Service, including any Loss arising from:
- any AI Output, including AI Output that is inaccurate, incomplete, misleading, offensive, or otherwise inappropriate;
- any decision you make, or action you take or refrain from taking, based on or in reliance upon AI Output;
- any Sensitive Input you submit to the AI Service, or any AI Output generated in response to Sensitive Input;
- any interruption, suspension, or discontinuation of the AI Service; or
- any unauthorised access to, or use of, your User Input or account.
- To the extent that our liability cannot be excluded by law, our total aggregate liability to you for all claims arising out of or in connection with the AI Service is limited to the amount you have paid to us for use of the AI Service in the 12 months immediately preceding the event giving rise to the claim.
- Nothing in this Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
11. FORCE MAJEURE
- We are not liable for any failure or delay in making the AI Service available or performing any obligation in connection with this Policy to the extent that the failure or delay is caused directly by a Force Majeure Event, provided that:
- we use reasonable endeavours to minimise the impact of the Force Majeure Event and to resume normal service as soon as practicable; and
- the failure or delay is not attributable to our negligence, wilful misconduct, or failure to take reasonable precautions.
- If a Force Majeure Event prevents us from making the AI Service available for a continuous period of more than 60 days, we may discontinue the AI Service (in whole or in part) without liability to you.
- For the purposes of this Policy, Force Majeure Event means any event or circumstance beyond our reasonable control, including:
- acts of God, flood, earthquake, storm, cyclone, or other natural disaster;
- epidemic, pandemic, or public health emergency declared by a government authority;
- war, invasion, acts of terrorism, riot, or civil unrest;
- government action, law, regulation, order, or embargo;
- failure of third party infrastructure, including telecommunications, power networks, or cloud computing services; and
- cyberattack, distributed denial of service attack, or other malicious interference with digital infrastructure.
- For the avoidance of doubt, a Force Majeure Event does not include financial difficulty or inability to pay.
12. GENERAL
- Governing Law: this Policy is governed by and construed in accordance with the laws of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
- Severability: If any provision of this Policy is held to be invalid, illegal, or unenforceable, that provision will be severed from this Policy and the remaining provisions will continue in full force and effect.
- Waiver: A failure or delay by us in exercising any right, power, or remedy under this Policy does not operate as a waiver of that right, power, or remedy. A single or partial exercise of any right, power, or remedy does not preclude any other or further exercise of that right or any other right, power, or remedy.
- Entire Agreement: this Policy, together with our Website Terms of Use and Mobile App Terms of Use and Privacy Policy and Website Disclaimer constitute the entire agreement between you and us in relation to your use of the AI Service and supersede all prior agreements, representations, and understandings.
- Assignment: You may not assign or transfer any of your rights or obligations under this Policy without our prior written consent. We may assign or transfer our rights and obligations under this Policy to any third party without your consent.
